New Milford man held on assault charge



A New Milford man faces charges after he allegedly gave a 16-year-old female beer and then inappropriately touched the girl.

Michael Smith, 38, was charged by Tpr. Greg Deck with corruption of minors and indecent assault stemming from an alleged July 17 incident in New Milford Twp.

Smith waived his preliminary hearing Monday in Montrose District Court. He is being held on $10,000 bail.

According to the affidavit, Smith offered the teenage girl beer, engaged in small talk with the alleged victim and then began to touch her breast area on the outside of her shirt.

Smith, according to the victim’s statement to police, then told her to spread her legs but she refused and told him “no.”

The alleged victim returned to her home, according to the affidavit, and Smith followed – attempting to get her to leave with him.

She also told police that Smith threatened to hurt her family if she told anyone what happened.

A witness, present at the time Smith allegedly made the threats, corroborated the victim’s account of the threats in an interview with police.
